1. Agreement to Terms

These Terms and Conditions apply to the Leben in Deutschland Test Prep app (hereby referred to as "Application") for mobile devices that was created by Nnaji Victor (hereby referred to as "Service Provider") as a Freemium service.

By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

2. Eligibility

• Minimum Age: You must be at least 16 years of age to use this App.
• Parental Consent: If you are under 18, by using this App, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to suspend accounts if we discover usage by minors without consent.

3. Service Description

Leben in Deutschland Test Prep is an educational tool designed to help users prepare for the German citizenship and integration test.

• Free Tier: Includes access to general questions and a limit of 3 full mock exam attempts per device.
• Premium Tier (€9.99): A one-time purchase providing unlimited mock exams, advanced study tools (tags, bookmarks), and detailed explanations.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

4. User Accounts & Security

To access certain features (like cloud sync), you must create an account via Google OAuth. You are responsible for maintaining the security of your account and device.

Device Security: The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions imposed by the official operating system. Such actions could expose your phone to malware, compromise security features, and may result in the Application not functioning correctly.

5. Intellectual Property & Acceptable Use

5.1 Ownership

App Content: All translations, explanations, app design, source code, and user interface elements are the exclusive property of the Service Provider. Unauthorized copying, modification, or creation of derivative works is strictly prohibited.

BAMF Content: The test questions are based on official materials published by the Federal Office for Migration and Refugees (BAMF). These are used for educational purposes.

5.2 Prohibited Activities

• Sharing or reselling premium account access.
• Copying, scraping, or redistributing app content.
• Attempting to bypass the free exam limit through technical means (e.g., device ID spoofing).
• Using the App for commercial purposes without permission.

6. Purchases and Refunds

• Payment Processing: All payments are processed by Apple App Store or Google Play Store via RevenueCat. We do not store payment information.
• Refunds: All purchases are final. Refund requests must be directed to Apple Support (iOS) or Google Play Support (Android) according to their respective refund policies.
• Access Revocation: We reserve the right to revoke premium access without refund in cases of fraud, refund abuse, or Terms violation.

7. Connectivity and Updates

Some functions of the Application require an active internet connection. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of Wi-Fi or data allowance.

• Data Charges: If using mobile data, you accept responsibility for any charges from your provider, including roaming charges.
• Updates: The Service Provider may update the Application at any time. You agree to accept updates when offered. We may also cease providing the Application at any time without notice.

No Guarantee of Success: Passing our practice tests does NOT guarantee passing the official Leben in Deutschland test. The App is provided "AS IS" and "AS AVAILABLE" without warranties of accuracy or completeness.

10. Limitation of Liability

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data, profits, or business opportunities. We are not responsible for errors in the content or reliance on third-party services.

Our total liability to you for any claims arising from the App shall not exceed the amount you paid for premium access (€9.99), or €50 if you are a free user.

11. Changes to Terms

The Service Provider may update these Terms and Conditions from time to time. You are advised to review this page regularly for any changes. Continued use of the Application after changes constitutes acceptance of the new Terms.
